Imaam Shaafi’ (Rahmatullahi alaih) said: “A person who takes an intoxicant purposely is not marfoo’ul qalam. [In other words, his actions are still recorded by the recording angels – kiraaman kaatibeen.]
Yes, a majnoon [insane person] is marfoo’ul qalam. [He is not accountable for his actions.] Hence Imaam Zuhri said that an intoxicated person’s talaaq stands.”
