Saving lives in Islam…

One of the important objectives of Shariat…

 و من أحياها فكأنما أحيا الناس جميعا

”He who saves one life, it is as if he saved the entire humanity”

 

This has sort of formed the basis of the call to keep the Masjid closed.

 

Otherwise, we are convinced that no same Muslim in his right mind would ever entertain the idea of closing the Masjid.

 

Before we embark on understanding the issue at hand, we need to refresh our memories regarding the ‘categories/degrees of knowledge’.

 

(This generally is discussed in the beginning pages of mantiq and usoolul fiqh kitaabs)

 

  • 100% يقيني، قطعي

 

  • 51%-99% ظن

 

  • 50 % شك

 

  • 1%-49% وهم

 

  • 0% جهل (بسيط)

 

  • 0% جهل مركب

 

Translation and examples of the above Sharí principles

 

  1. Basically, if there’s not a shadow of doubt, it’s definite, 100%

 

                Then is ‘zann’ , with varying degrees.

 

  1. Then is 50/50, you not sure, bayn bayn, half/half

 

  1. Then is ‘mowhoom’, with varying degrees… remote possibility, extremely remote possibility, almost non existent..

 

  1. Then if you have no knowledge. 0%. You don’t know.

 

  1. Then below that, if you don’t know, but you don’t know you don’t know!!!

 

That’s جهل مركب

 

Now just a quick glance at the stats released daily…

In South Africa, only 0.00009% of the population died WITH/OF corona, within 5 weeks.

 

Only 0.0005% of the population were tested positive.

 

From this relatively negligible amount of people infected, 80% don’t require any treatment.

 

This is all from the Department of Health, South Africa.

 

Now you don’t have to be a rocket scientist to be able to fit this in one of the categories above.

 

I’m confident in your intellectual capabilities that you won’t assign it to the degree of وهم which is closer to شك,  let alone شك , let alone ظن.

 

And you don’t have to:

 

-Graduate from Deoband

 

– or do post graduate studies in al-azhar,

 

– neither do you have to be the Mufti of any organization,

 

Neither do you have to be a master at certifying ABSA’s interest bearing transactions as halaal,

 

Neither do you have to be a poet,

 

Neither do you need to know the intricacies of the ‘evolution’  of fiqh…

 

You don’t need any of these…to Know that laws of Shariat are NOT based on remote possibilities, let alone EXTREMELY remote possibilities.

 

Just a simple example:

 

You get in behind the drivers wheel.

 

There’s no certainty that your tyre will blow. There’s not even a 50/50 chance.

 

Yes, there’s a remote possibility that your tyre will blow. 

 

Now, of your tyre blows, it’s not definite you’ll have an accident. But it’s greatly likely.

 

If you have an accident, it’s not definite you’ll be injured, but there’s a great likelihood or possibility.

 

If you get injured, it’s not definite that you’ll die, but there is the possibility of dying due to your injuries.

 

Will any shaykh venture to declare driving on public roads impermissible?

 

Since there’s a possibility of having a blow out, resulting in a possible accident, resulting in possible injuries, resulting in possible death.

 

Now apply the same fiqhi gymnastics to covid 19.

 

If you gather in one place, there’s a remote possibility of being infected.

 

If you get infected, then there’s a remote possibility of needing treatment. If you need treatment, there’s a remote possibility of needing hospitalization. If you are

 

hospitalised, then there’s a remote possibility of you dying.

 

So we declare that it’s not permissible to gather in one place.

 

Which place is that?

 

Open cast mines? No.

 

Closed mines? No.

 

Supermarkets? No.

 

Public transport? No.

 

Courts?  No.

 

Farms? No.

 

Food production facilities? No.

 

This absurd fiqhi gymnastics only apply to the Masjid

 

إنا لله وإنا إليه راجعون

 

و لكن تعمى القلوب التي في الصدور
