Subject: Objection to the Al Jama’ah Nikah Bill

Addressed to: The Speaker of the National Assembly of South Africa

Criterion: Objection to the ‘ Nikah’ (Marriage) Bill proposed by the Al Jama-ah Party

I, xxxxxxxxxxxxx, hereby declare under oath as a Muslim female South African citizen, that I oppose the Nikah Marriage Bill being proposed by the Al Jama-ah party.

I request Parliament to urgently take into consideration the below-mentioned factors which render the Al-Jama-ah Party incapable of acting as representation for the South African Islamic community (or any other Islamic community globally), as well as why the Marriage Bill cannot in any way benefit any Muslim community or even be recognised as being part of Islam:

It is incumbent upon Muslims to strictly adhere to Islamic Shari’ah Law, which means adherence to the rulings of the Islamic Scriptures (the Holy Qur’an and Hadith).

According to Chapter 5 in the Holy Qur’an, verse numbers 42, 43, 44, 48, 49, 51, Muslims are commanded to follow only Shari’ah law, meaning Shari’ah law in its purest form. Any dilution or affiliation with any secular law, renders the law unIslamic, void of Islamic Divine guidance and instruction. By Qur’anic definition alone, a “Muslim” removes himself from the fold of Islam once he/she makes the decision to dilute Islamic rulings with those that are secular, and allowing secular authority to govern such acts.

Islam never was, and never will be, in requirement of any secular intervention nor secular approval to perform what is incumbent upon Muslims. Any so-called “Muslim” who claims that Muslims in a secular country, such as South Africa, requires secular intervention, is by Qur’anic definition NOT A MUSLIM. The very revelation and existence of the Qur’an serves to be a mercy from our Creator the Almighty to all mankind, where Messengers had been Divinely appointed to perpetuate its meaning and inculcation to people. There is nothing any modern day political party or politician can do to be a beacon of hope to Muslims. In fact, this would be a “false” beacon of hope, which in reality takes both the political party members and the Muslims following their call, OUT of the fold of Islam. The fact that the Al Jama-ah party and its members believe that they can do this proves that they are void of Islamic knowledge and do not know what Islamic Shari’ah law is.

The Al Jama-ah party claims that Muslim women feel they are not protected by the South African Legislation and that Islamic Institutions have failed them. The Al Jama-ah party says and I quote “Muslims are not prepared to abandon Islamic rulings on marriages as they are not willing to betray their faith.”
If there are Muslim women who feel this way about Islamic institutions, their dissatisfaction should still be dealt with from an Islamic perspective as resorting to secular intrusion contradicts the latter statement. They will most certainly be abandoning Islamic rulings when they seek to have the secular South African law play a decisive role in their marital disputes.

It will just be a matter of time before these same women realise that they have erred in seeking solace in the filtered-out diluted version of their Islamic law mixed with South African law, when magistrates and court officials start enforcing rulings not akin to their liking, and they will likewise complain that their needs have not been met again.

This is to be expected, as with any trial in a Muslim’s life, Muslims are commanded to pray and have patience. There are without a doubt good Islamic learned scholars and Islamic governing bodies that exist in South Africa, such as the Majlisul Ulama. If a distraught Muslim woman prays and perseveres she will by the Grace and Will of Almighty Allah be directed to sympathetic and Islamically capable and Islamically knowledgeable institutions like The Majlisul Ulama, who will advise her and give her assistance and guidance regarding her issues.

The Al Jama-ah party consists of unqualified “politicians”, “muslim leaders” and “advocates”. One such advocate, is Shameema Salie. This woman is a spokesperson for the Al Jama-ah party. She deceptively portrays herself to be a caring activist for women in abuse, when in reality she is cold-hearted, and does not bear any emotion for suffering women and children.

I speak from experience, as this “Advocate” Shameema Salie was the family advocate who interviewed myself and my ex-husband. After my abusive ex-husband insisted he wants to take my two babies to his home and also threatened he will take my children away from me in 2015, I had sent in an appeal to the Family Advocate’s office. I requested in writing that I not be forced to hand my baby son and daughter to my abusive ex-husband for visitation to his home, due to the fact that he was not only abusive and resorted to violence when I was pregnant, but also that he was a porn addict.

Despite the fact that my ex-husband clearly admitted verbally to her (Shameema Salie), in my presence, that he is in fact addicted to pornography AND frequented brothels after his working hours whilst married to me and nearly infecting me with HIV, this Shameema Salie’s response to me was:

“The pornography is not a reason to have the children be kept away from their father’s home and there are babies as young as 2 months and 6 months old who are away from their mothers.”

In that same week, I typed a lengthy email complaining about her mediation and her report, and stated that she is unprofessional, cold and biased. I received a reply email from her stating that she has “already closed my file” , that she is no longer working on my case and that she is resigning.

I was in utter shock at this woman’s brutal way of mediating the matter, where she had absolutely ZERO compassion for myself and my children. It is now 2022 and my children have complained to me of abuse and exposure to pornography at the hands of my ex-husband, and my children have refused going to him for over a year already.

This so-called “gender-based violence” activist Shameema Salie, does not care for women, but she is on the panel of members for the Al Jama-ah party, who also claim to have the best interests of Muslim women at heart.

The Al Jama-ah party, Shameema Salie and the Nikah Marriage Bill all need to be scrapped and exposed for the insults they are to Muslim women and to the Muslim community at large.

I hope you will take all my points into serious consideration as I am submitting this objection for the benefit of all South African Muslims.

The bills proposed by Al Jama-ah must be rejected. Al Jama-ah‟s exercise is simply old wine, not even in a new bottle. Only the label has been slightly altered in a futile endeavour to mislead ignorant Muslims into believing that the Shariah consequences will apply when Talaaq occurs. But this idea is a canard – a falsehood. Everything proposed in these bills is in vivid conflict with the Shariah. One must be totally blind not to observe and understand the kufr being proposed by Al Jama-ah.

There’s no positive outcomes of the Bill. It only gives the government the rights over our nikah. They’ll hand over divorce rights unilaterally to women, completely against Shari’ah. By default your any marriage in SA becomes community of property unless stated otherwise.  You’ll get the Secular Law dictating laws of polygamy. Any dispute in a marriage can be taken to the Secular court for them to judge according to Secular law.

Being happy with kufr is kufr
